Fees

One benefit of choosing RMAS is the simplicity of our fee structure. RMAS charges $225.00 per hour for the arbitrator, plus out of pocket expenses. There are no other administrative fees.

Maximum Daily Arbitrator’s Fee. When the arbitrator conducts a hearing, there is a maximum daily charge of $1,800.00. If the hearing lasts longer than eight hours or if the arbitrator incurs travel time on the hearing date, the maximum charge for that day is still $1,800.00

Travel Time. RMAS charges $125.00 per hour for the arbitrator’s travel time; however, the maximum daily charge of $1,800.00 for the arbitrator still applies.

Required Deposits for Internet Arbitration. A party that submits a claim under the RMAS Internet Arbitration rule (Rule 12) must submit a deposit of $500.00 with the claim. Each Respondent in such an action must also submit a deposit of $500.00 with the response. These deposits are not refundable and represent the minimum amount that RMAS will charge. After the arbitrator issues the Initial Conference Order (Rule 11), RMAS will notify the parties if it will require any additional deposits, the amount of any such deposits, and the deadlines for payment.

Required Deposits for Other Arbitration.

i. Initial Deposits. A party that submits a claim seeking a telephonic or in person hearing (Rule 13) must submit a deposit of $1,250.00 with the claim. Each Respondent in such an action must also submit a deposit of $1,250.00 with the response. These deposits are not refundable and represent the minimum amount that RMAS will charge.

ii. Required Additional Deposits. At any time after the arbitrator issues the Initial Conference Order (Rule 11), RMAS may notify the parties if it will require any additional deposits, the amount of any such deposits, and the deadlines for payment. RMAS will monitor the arbitrator’s time and the expenses it advances, and may periodically require such additional deposits as it deems appropriate.

iii. Deposits in Advance of Hearings. If the parties anticipate a one-day hearing, RMAS will require each party to pay a deposit of $1,250.00 at least 45 days prior to the hearing. If the parties anticipate that the hearing will last longer than one day, the required deposit will increase by $1,000.00 for each additional hearing day.

Expenses. RMAS charges for its out of pocket expenses, including fees for room rental (for hearings not held on site or at our Nederland office), overnight mail, mailing of packages (not letters), certified mail, long-distance telephone calls for hearings, bulk copying, airfare and public transportation for the arbitrator, hotel expenses for the arbitrator, Westlaw charges, and other similar expenses. Where the arbitrator deems it appropriate RMAS may hire clerical help for a hearing, in which case RMAS will charge for that expense.

Cancellations. If a hearing is cancelled within 14 days of the scheduled hearing, RMAS charges a $1,000.00 cancellation fee.

Refunds. When an arbitration award is final and RMAS has been paid all fees and expenses owed by all parties, RMAS will refund any deposits, except the nonrefundable portions that represent the minimum charge.
